Terms of Service
Last updated: May 2025
1. About these terms
These terms and conditions govern your use of the Wallace Collective website and the purchase of products or services from us. By using our website or placing an order, you agree to be bound by these terms. Please read them carefully before proceeding.
Wallace Collective is based in Scotland. If you have any questions, please contact us at hello@wallacecollective.co.uk.
2. Using our website
When using our website, you agree to:
- Use the site only for lawful purposes and in a way that does not infringe the rights of others
- Not attempt to gain unauthorised access to any part of the site or its related systems
- Not transmit any harmful, offensive, or disruptive content
- Provide accurate and truthful information when placing orders or submitting enquiries
We reserve the right to restrict or terminate access to the site for anyone who breaches these terms.
3. Orders and contract
When you place an order through our website, you are making an offer to purchase the selected products. A binding contract is formed only when we confirm your order by email. We reserve the right to refuse or cancel any order, for example, if a product is out of stock, if there is a pricing error, or if we are unable to verify payment.
For bespoke or made-to-order items, additional lead times may apply and will be communicated at the point of order.
4. Pricing and payment
All prices shown on our website are in pounds sterling (£) and inclusive of VAT where applicable. We take reasonable care to ensure prices are accurate, but errors may occasionally occur. If we discover a pricing error on your order, we will contact you and give you the option to proceed at the correct price or cancel your order.
Payment is taken at the point of order. We use a secure, third-party payment provider and do not store your card details on our systems.
5. Delivery
Delivery timescales vary by product and are indicated on each product listing. We aim to dispatch in-stock items promptly, but we cannot guarantee specific delivery dates. Risk of loss or damage passes to you upon delivery.
For large or specialist items (such as pergola structures or outdoor kitchen units), installation may be arranged separately. Any installation services are governed by a separate agreement.
6. Returns and cancellations
Under the Consumer Contracts Regulations 2013, you have the right to cancel most orders within 14 days of receiving your goods, without giving a reason. To exercise this right, please contact us at hello@wallacecollective.co.uk within this period.
The following exceptions apply:
- Bespoke, custom-made, or made-to-order products cannot be returned unless faulty
- Items must be returned in their original condition and packaging
- You are responsible for return postage costs unless the item is faulty or incorrectly sent
Refunds will be processed within 14 days of receiving the returned goods.
7. Design consultations
Design consultation bookings are subject to availability. If you need to cancel or reschedule, please give us at least 48 hours' notice. Consultations are provided to help you explore outdoor design options with Wallace Collective, they do not constitute a binding design or installation contract.
8. Intellectual property
All content on this website, including text, images, logos, and design, is owned by or licensed to Wallace Collective. You may not reproduce, distribute, or use any content without our prior written permission, except for personal, non-commercial use.
9. Limitation of liability
To the fullest extent permitted by law, Wallace Collective is not liable for any indirect, incidental, or consequential losses arising from your use of our website or products. Our total liability to you for any claim shall not exceed the amount you paid for the relevant product or service.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Scottish or UK law.
10. Governing law
These terms are governed by the laws of Scotland. Any disputes arising from these terms or your use of our website shall be subject to the exclusive jurisdiction of the Scottish courts.
11. Changes to these terms
We may update these terms from time to time. When we do, we will update the date at the top of this page. Continued use of our website after changes are posted means you accept the updated terms. We recommend checking this page periodically.
